These Terms and Conditions (the "Terms") govern all contracts of sale made by RayGar Ltd ("the Company") and are binding upon all interactions with the Company.
1. Acceptance of Orders
All orders are subject to our acceptance communicated through an email advising of cleared payment and delivery details. The Company's final acceptance email signifies order acceptance. Orders are fulfilled based on these terms unless agreed upon otherwise in writing.
2. Carriage
Postage and Packing Charges are waived for standard delivery options, unless explicitly stated otherwise. We aim to provide free shipping as the default option for your convenience.
3. Prices
Goods are invoiced at the prevailing price upon order acceptance, inclusive of VAT. Prices on our website are updated regularly, though the Company reserves the right to modify prices for unaccepted orders. Product images may display the main product only; accessories or accompanying items are excluded unless otherwise specified.
4. Delivery
a) Delivery times are estimated; the Company isn’t liable for failure to deliver within quoted or specific time frames. Any delays in delivery don't warrant liability for loss or damage.
b) The Customer must report shortages or damage within 48 hours of goods receipt via email.
c) The Customer is obligated to accept goods upon delivery. The risk of loss or damage passes to the Customer upon delivery.
d) The Company may store undelivered goods with associated costs after 7 days. After 60 days, unsold goods may be sold or charges incurred.
e) Additional charges apply for restricted access or extra equipment required for delivery.
f) Re-delivery charges apply if delivery fails due to the Customer not being present or for other reasons.
g) Failure to contact couriers regarding undelivered items may incur additional costs upon return.
5. Payment Terms
Payment in Euros (€) is standard. Currency conversions are approximate; prevailing exchange rates apply. Overdue invoices incur interest charges. To view prices in £GBP, visit our UK website by using the drop down currency selector in the top corner.
6. Property and Title
Goods' property and title remain with the Company until full payment is received, and the Customer indemnifies the Company for any loss or damage until ownership transfer.
7. Force Majeure
The Company is relieved of obligations due to uncontrollable events like Acts of God, War, or Strikes.
8. Returns and Cancellations
Unused, undamaged goods may be returned within 30 days with Company agreement. Customers bear return costs, and refunds exclude transport and insurance expenses.
9. The Company's Liability
a) The Company isn’t liable for indirect or consequential losses.
b) Liability for breach or non-performance is limited to the invoiced value.
c) Goods are not sold as fit for a specific purpose or conditions.
d) Statutory rights under consumer transactions are not affected by these Terms.
e) All items sold are intended for domestic use only. The Company does not accept responsibility if used for contract/commercial purposes.
10. Distance Selling Regulations
Cancellation rights under Consumer Protection (Distance Selling) Regulations apply. Costs for non-performance related cancellations are borne by the Customer.
11. Miscellaneous
a) Invalidity of any provision won't affect remaining provisions.
b) Waivers or indulgences by the Company don’t affect rights herein.
c) Headings are for convenience and not part of the Terms.
d) Telephone transactions may be recorded for staff training only.
